Terms and Conditions
1. Information on how to enter and prizes form part of these Terms and Conditions. By participating in the Find Yourself Now promotion ("Promotion") each entrant agrees to abide by these Terms and Conditions. Any entry not complying with these Terms and Conditions is invalid and will not be accepted.
2. Entry is open only to residents of NSW who are 18 years of age and over. Directors, employees of the Promoters, the Promoters’ associated companies, the Promoters’ agencies associated with this Promotion, the participating retailers and their immediate families are ineligible to enter.
3. The Promotion commences at 09:00am AEST on 17.08.08 & concludes at 23:59pm AEDT on 12.10.08 ("Promotion Period").
4. To enter, participants must, during the Promotion Period, either:
- (a) obtain a Cumberland or Courier Newspaper, fully complete the entry coupon located in that newspaper and then mail the entry coupon to “Find Yourself Now” PO Box 517, Eastern Suburbs MC NSW 2004;
OR
- (b) make any purchase at any participating retailer as listed in the Cumberland and Courier Newspapers (“Eligible Purchase”) to receive an entry form containing a unique code and either:
- fully complete and mail their entry form to “Find Yourself Now” PO Box 517 Eastern Suburbs MC NSW 2004; or
- log onto www.findyourselfnow.com.au and fully complete the online entry form by entering their name, address, phone number, the name of the store they made their Eligible Purchase from and their unique entry code.
5. Prizes in the Promotion will be distributed through weekly draws, a major draw as well as by instant win (for online entrants). Participants may enter the weekly draws and the major draw as many times as they wish provided that each entry is based on either a separate original newspaper entry coupon or based on a separate Eligible Purchase (and a separate unique code). Post office box addresses will not be accepted. Participants who enter in accordance with 4(b) are required to retain their receipt(s) to verify each entry. Failure to provide this/these to the Promoters’ upon request may, at the Promoters’ discretion, result in an invalid entry (and, at the Promoters’ discretion, in all of the entrant’s entries being invalid). The Promoters may require entrants to provide proof of entry for all entries made in order to be entered into the prize draw or to claim a prize. This includes entries made by a single person/s or family groups via multiple email addresses. Entrants using multiple aliases and/or email addresses will be disqualified.
6. All entries will be entered into the relevant weekly prize draw and the major prize draw. Participants who enter online also have the chance to win an instant win prize. Online entrants will be notified as to whether or not they have won an instant win prize at the time of entry and will be provided with details on how to claim their prize on the website.
7. Entries must be received by the following dates (by 2pm AEST or AEDST (dependant on date) for online entries or by last mail received for mail entries: Weekly prize draws: for entry into the relevant weekly prize draw entries must be received by 29.08.08 (Wk 1); 05.09.08 (Wk 2); 12.09.08 (Wk 3); 19.09.08 (Wk 4); 26.09.08 (Wk 5); 03.10.08 (Wk 6) and 10.10.08 (Wk 7); Major prize draw: for entry into the major prize draw entries must be received by 17.10.08.
All valid entries received by the relevant date above will be entered into each subsequent weekly draw. Both mail and online entries received each week will be entered into the remaining weekly draws (if any).
8. There will be 7 weekly draws conducted with 2 winners drawn in each weekly draw. The weekly prize draws will be conducted at 3pm AEST or AEDT (depending on the draw date) at Unit 4b, 106 Old Pittwater Road, Brookvale, NSW 2100 on the following dates: Week 1: 02/09/08, Week 2: 09/09/08, Week 3: 16/09/08, Week 4: 23/09/08, Week 5: 30/09/08, Week 6: 7/10/08, Week 7: 14/10/08.
9. The Major Draw will take place on 21/10/08 at 3pm AEDT. The draw will be held at Unit 4b, 106 Old Pittwater Road, Brookvale, NSW 2100. The first valid entry randomly drawn will win the Major Prize Package.
10. Winners over $100.00 will be notified in writing within 7 days of the relevant draw. Week 1-4 weekly winners will have their names and state of residence published on the www.findyourselfnow.com.au website on 16/10/08. Week 5-7 weekly winners as well as the Major Prize winner will have their names and state of residence published on the www.findyourselfnow.com.au website on 13/11/08.
11. In the event of any prize not being accepted or claimed within 3 months of the date of the major prize draw, the relevant winner’s entry will be deemed invalid and the Promoters may conduct such further draws at Unit 4b, 106 Old Pittwater Road, Brookvale, NSW 2100 on the 27/01/09 at 3pm AEDT as are necessary in order to distribute any prizes unclaimed by that date (including instant win prizes), subject to any written directions given by any relevant authority. Winners (if any) will be notified in writing within 7 days and have their names and state of residence published on the www.findyourselfnow.com.au website on 19/02/09.
12. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid. All entries are deemed to be received at the time of receipt into the Promotion database and NOT at the time of submission by the entrant. The Promoters accept no responsibility for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence whether due to error, omission, alteration, tampering, deletion, theft, destruction, transmission interruption, communications failure or otherwise. The Promoters have no control over telephone communications, the Internet, networks or lines and accepts no responsibility for any problems associated with them, whether due to traffic congestion, technical malfunction or otherwise. The Promoters are not liable for any consequences of user error including (without limitation) costs incurred.
13. The Promoters reserve the right to request winners to provide proof of identity, proof of age and proof of residency registered as the prize delivery address. Identification considered suitable for verification is at the discretion of the Promoters.
14. The Promoters reserve the right to verify the validity of entries and reserves the right to disqualify all entries from, and prohibit further participation in this competition by, any person who tampers with or benefits from any tampering with the entry process or with the operation of the competition, including but not limited to the utilisation of techniques designed for multiple entries that are not associated with a separate promotional unique code, for submitting an entry that is not in accordance with these Terms and Conditions, or acts in a disruptive manner or acts with the intent to annoy, abuse, threaten or harass any other person.

17. MAJOR PRIZE PACKAGE:

18. Total prize pool is valued at up to $83,816.55 RRP, is in Australian dollars and includes GST. The Promoters accept no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought. Where the operation of this competition results in, for GST purposes, supplies being made for non-monetary consideration, entrants agree to follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values.
19. All prizes are subject to their own terms and conditions.

In the event that, for any reason whatsoever a winner does not take an element of the prize at the time stipulated by Travelodge Hotels, then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element. Prize is not refundable, non-endorsable and non-transferable. Bookings are subject to availability and seasonal embargo periods apply. Travelodge Hotels’ prize is for two consecutive night’s accommodation for two in a standard room including full buffet breakfast for two people daily and does not include any extra charges (i.e. mini bar, in house movie, telephone usage, etc). Valued at $903 and can be redeemed at any Contours studio in Australia before 30th November 2008. Winner must contact Contours Headquarters on 1300 657 339 to activate membership prior to redemption. One membership per person. Not available to current Contours members or in conjunction with any other Contours offer. Offer is not exchangeable for cash, non-transferable and is void if on-sold.

The winner is responsible for arranging their attendance at the premises of the dealer nominated by the Promoter to collect the vehicle. The winner must provide all information and sign all documentation necessary to enable the Promoter to register the vehicle in the winner’ name prior to collection. To be eligible to claim the vehicle, the winner must be capable of obtaining registration of the vehicle in his or her name in accordance with the applicable legislation in the State or Territory in which the vehicle is collected. If the winner is, through any legal incapacity or otherwise unable to register the vehicle in his or her name then he or she may, notwithstanding any condition set out in these conditions of entry to the contrary, assign the vehicle to another person with legal capacity for the purpose of registration of the vehicle.

20. Prizes are not transferable or exchangeable and cannot be taken as cash, unless otherwise stipulated. In the event for any reason a winner does not take an element of a prize at the time stipulated by the Promoters then that element of the prize will be forfeited by the winner and cash will not be supplied in lieu of that element of the prize. Prize values are correct at the time of printing. The Promoters accept no responsibility for any variation in the value of any prizes. Where a prize is unavailable for any reason, the Promoters may substitute for that prize another item of equal or higher value as determined by the Promoters, subject to the approval of the gaming authorities in each state and territory, where required.
21. The Promoters and their associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this competition or accepting or using any prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
22. All entries become the property of the Promoters. The information entrants provide will be used by the Promoters for the purpose of conducting this competition. The Promoters may disclose entrants’ personal information to its contractors and agents to assist in conducting this competition or communicating with entrants. Entrants can request access to the personal information the Promoters holds about them by contacting the Promoters at their respective addresses below.
23. The Promoters’ decisions are final and no further correspondence will be entered into.
24. The Promoters provide no warranties or guarantees in relation to the description or quality of any prizes and winners should look to the manufacturer or supplier for all warranties and guarantees as well as any terms of use.
25. By entering the competition, all prize winners agree to, at the Promoters’ request, participate in all promotional activity (such as publicity and photography) surrounding the winning of any prize, free of charge, and they consent to the Promoters using their name and image in promotional material, without compensation, and agree that the Promoters will own copyright of any such images and photograph/s and in all material incorporating these.
26. Prizes will only be delivered within Australia and winners should allow 28 days from claim date for delivery of their prize. The Promoters and their associated agencies and companies will not be liable for any damage in transit to prizes.
27. If for any reason the Promotion is not capable of running as planned, including whether caused by infection by computer virus, phone line drop out, bugs, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the reasonable control of the Promoters which corrupts or affects the administration, security, fairness, integrity or proper conduct of the Promotion, the Promoters reserve the right in their sole discretion, (subject to any written direction given by a relevant gaming authority), to cancel, terminate, modify or suspend the Promotion or invalidate any affected entries.
28. Quality control errors outside the Promoter’s control will not invalidate an otherwise valid instant win prize claim. Every instant win prize claim in excess of the advertised prize pool will be honoured, unless such claim is rejected due to fraud or ineligibility under these conditions.
